Samantha Chirichella, 26, from New York was about to start working as a staff investigator in the legal department of an energy firm Consolidated Edison for $70,000 a year. But after her future bosses made a background check on her, they stumbled upon her lesbian selfie in Instagram. The young woman is featured with another topless woman as they are kissing each other’s nipples. That’s when they withdrew their job offer. The photo was made 3 years ago and is no longer available after her account was made private.
The young woman intends to take the firm to court because she believes she was discriminated against because of her sexual orientation.
Chirichella's lawyer said in court papers: “The work was no more sexually explicit that the works of DaVinci, Titian or Michaelangelo, and less explicit that photos published in Sports Illustrated.”The photo was even once shown at an art gallery during an exhibition of photography by one of Samantha’s friends.Apparently, the company is reviewing the case.
