Riah, "As it appears"? So you're eyeballing it, rather than looking up the actual distance? If so, then you don't actually know how far away it is and you cannot declare the photo a fake.
Nobody said the ISS is near the Sun, it's just "transiting the sun". As in: it orbits the Earth and it passes between the observer (the Earth) and the Sun, traversing its area (transiting).
