Dark clothes, no lights or reflective pads on the bike and going in the middle of the road is dumb@$$ery for sure, but in no way does it justify the driver hitting him.

Doesn't anyone know laws anymore. Just because somone is doing stupid stuff doesn't make it illegal. Hitting them IS VERY illegal, especially on a well lit road. And the driver obviously knew they were there because they were not in lane and trying to pass.
